20. DUTIES OF DISTRICT-LEVEL OFFICE BEARERS
(1) The Chairman

The Chairman is empowered to:

  • Convene District-level Committee Meetings.

  • Chair all General Meetings and District Committee Meetings.

  • Cast the deciding vote and sign records of Meetings once passed.

(2) The Deputy Chairman
  • The Deputy Chairman shall:

  • Assist the Chairman in carrying out his duties.

  • Replace the Chairman should his post fall vacant and assume all the Chairman's duties and powers according to Paragraph 20 (1) (a).

(3) The Secretary

   The Secretary shall:

  • Administer the PROSTAR CLUB in the manner decided by the District Committee.

  • Prepare and distribute all minutes of PROSTAR CLUB meetings. The minutes shall be distributed within a period of four (4) weeks after the Annual General Meeting is held.

  • Record, prepare, and distribute the minutes of all District Committee Meetings.

  • Handle all correspondence of the PROSTAR CLUB.

  • Prepare and submit the Annual Report of the PROSTAR CLUB on behalf of the District Committee and distribute it. The report shall be distributed at least two (2) weeks before the first day of the Annual General Meeting.

  • Send out Notices at least fourteen (14) days before the General Meeting.

  • Send out Notices to the members of the District Committee of every Committee Meeting. At least half the number of Committee Members shall be present to form a quorum.

  • Be the Chairman of Annual General Meeting Management Committee.

  • Keep a register of members

  • Send a copy of the PROSTAR CLUB Annual Report to the State / Federal Territory Committee and to the Secretary-General of the Central Committee.

  • Carry out the administration of the PROSTAR CLUB in the manner decided by the District Committee.

  • Handle all correspondence of the PROSTAR CLUB

(4) The Treasurer

   •  The Treasurer shall:

  • Be responsible for the smooth running of the financial affairs of the District Committee.

  • Be the Chairman of the Financial Committee.

  • Prepare the Financial Statements for the District Committee to be examined by the Examiners of Accounts appointed at a General Meeting.

  • Submit the Financial Statements that have been audited and certified by the Examiners of Accounts at the General Meeting.

  • Inform the District and State Committees of the assets of the PROSTAR CLUB and Trustees at least once a year.

  • Receive all payments made to the PROSTAR CLUB and deposit the same into a bank account in the name of the District Committee.

  • Keep cash not exceeding RM500.00.

(5) The Assistant Secretary

•  The Assistant Secretary shall:

•  Assist the Secretary and act as the Secretary in his absence.

•  Assist the Secretary in recording and preparing the minutes of the District Committee Meeting.

•  Keep all notes and records of the PROSTAR CLUB.

•  Assume all the duties and responsibilities of the Secretary should the post fall vacant and not yet be filled.

•  Assist the Secretary in carrying out his duties.

(6) The Ordinary Members of the District Committee shall assist the District Committee by carrying out the duties given them by the District Committee.

(7) Formation of Bureaus at District Committee Level

•  Members may be appointed to be Chairmen of Sub-Committees that may be formed later by the District Committee, should the need for such Sub-Committees arise.

•  They shall perform all the tasks related to the Sub-Committees so formed.

•  They shall advise the District Committee on relevant matters.

•  They shall carry out such other tasks as are decided by the District Committee from time to time.

21.FINANCES OF STATE / FEDERAL TERRITORY BRANCHES

•  All monies collected at the Central Office and PROSTAR CLUB Branches shall become the assets of the PROSTAR CLUB.

•  The Annual General Meeting shall determine from time to time the proportion of fees collected that may be kept at the Branches as Branch Funds and shall determine the types of expenditure these Branch Funds may be used for.

•  Each Branch Treasurer shall, before the 15 th of the month, once in every three (3) months, hand over to the Chief Treasurer, the fees collected by each Branch, after deducting from that amount the proportion allowed to be kept as Branch Funds.

•  Each Branch Treasurer shall also, before the 15 th of each month, once in every three (3) months, submit to the Chief Treasurer a Statement of Income and Expenditure of the Branch.

•  All Branch monies shall be kept in the name of the Branch in a bank agreed upon by the Branch Committee and the account will be managed jointly by the President / Branch Chairman, Branch Treasurer and Branch Secretary. The Branch Treasurer is allowed to retain not more than RM500.00 (Ringgit Five Hundred) as cash in hand at any one time. Expenditures of more than RM5,000.00 (Ringgit Five Thousand) at any one time will not be permitted without the prior approval of the Branch Committee. Expenditures of less than RM5,000.00 at any one time may be approved by the President / Branch Chairman together with the Branch Secretary and the Branch Treasurer.

•  All monies, books and other assets of the PROSTAR CLUB kept by any Branch that has been dissolved shall immediately be sent by the Branch Secretary to the Secretary-General, together with a Statement of Accounts.

22. GENERAL PROVISIONS CONCERNING THE BRANCHES
•  Where there is no specific provision in these Laws providing for matters relating the administration of the Branches, then the relevant Laws relating to the administration of the Club's Central Office shall be followed as far as possible.

•  The Central Committee Meeting will direct the Branch General Meetings or Branch Committees on matters concerning their administration.

23. AMENDMENT OF LAWS

•  The Amendment of any Laws may only be discussed at the PROSTAR CLUB General Meeting. Members shall be notified of all proposed Amendments at least one (1) month before the General Meeting is held. Copies of the all the proposed Amendments, giving full details, shall accompany the circulars to all members informing them of the date of the General Meeting.

•  Any Amendments to these Laws may be proposed at the General Meeting and the Amendment/s shall be agreed on by two-thirds (2/3) of the Ordinary Members present. An application for an Amendment to the Laws shall be made to the Registrar of Societies within sixty (60) days of the decision of the General Meeting approving that Amendment and is only enforceable upon the approval of the Registrar of Societies.

24. INTERPRETATION OF LAWS

•  The Central Committee may give its own interpretations to these Laws and the Central Committee, where necessary, may decide on matters not contained in these Laws, before the General Meeting is held.

•  Except for matters that are against or not in agreement with the policies made in the General Meeting, the decision of the Committee on members is final, if not altered by any decision of the General Meeting.

25. PROHIBITIONS

•  The games stated below are not permitted to be played in the Clubhouse: Roulette, Lotto, Fan Tan, Poh, Peh Bin, Belangkas, Pai Kau, Tau Ngau Tien Kow, Chap Ji Kee, Sam Cheong, Twenty One, Thirty One, Ten and Half, dice games, Banker's game, video games, and all video games that depend entirely on luck.

•  The Club or its members shall not try to obstruct or in any manner whatsoever interfere with the business or the price of goods or take part in the Workers' Union movement as described in the Workers' Union Act 1959.

•  The Club shall not operate a lottery, whether only for members or not, under the name of the Club or its officials or the Committee or the members, without the prior approval of the authorities.

•  “Interest” as described under Section 2 Societies Act 1996, may not be extended to any member.
